Please read these Terms and Conditions ("Terms," "Agreement") carefully before using the Goalwatch.net website and its associated services (the "Service") operated by Bartosz Dąbrowski trading as Goalwatch.net ("us," "we," or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Accounts

1.1. Registration: When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

1.2. Eligibility: You must be at least 16 years of age to use the Service. By creating an account, you represent and warrant that you meet this age requirement.

1.3. Account Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. The Goalwatch.net Service

2.1. Service Description: Goalwatch.net provides a platform for users to set personal growth goals, track their progress ("Bricks"), and join or create small, supportive communities called "Villages" (each typically comprising up to 9 members). Within Villages, members support each other by reading "Bricks," providing encouragement, and fostering accountability. Villages may also participate in friendly, weekly "Sprints," competing against other Villages for "Brick points" based on consistency and support.

2.2. No Guarantees of Achievement: While Goalwatch.net provides tools and community support designed to aid goal attainment, we do not guarantee the achievement of any specific goal. Your success depends on your effort, commitment, and participation.

2.3. Not Professional Advice: The Service, its content, and interactions within Villages are not intended to provide professional advice (e.g., medical, psychological, financial, legal). You should consult with qualified professionals for specific advice tailored to your situation.

3. User Conduct and Content

3.1. User-Generated Content ("UGC"): Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("User Content," which includes "Bricks," comments, and other Village discussions). You are solely responsible for the User Content that you post on or through the Service, including its legality, reliability, and appropriateness.

3.2. Your Responsibilities Regarding UGC: By posting User Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service. You retain any and all of your rights to any User Content you submit, post or display on or through the Service and you are responsible for protecting those rights. You agree that this license includes the right for us to make your User Content available to other users of the Service, who may also use your User Content subject to these Terms.

3.3. Prohibited Content: You agree not to post any User Content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Promotes self-harm, violence, illegal activities, or discrimination.
  • Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
  • Constitutes unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
  • Impersonates any person or entity, including, but not limited to, a Goalwatch.net official, forum leader, guide, or host, or falsely states or otherwise misrepresents your affiliation with a person or entity.
  • Is off-topic, disruptive, or harmful to the community experience.

3.4. Moderation Rights: We reserve the right, but are not obligated, to:

  • Monitor, review, edit, or remove any User Content that we determine in our sole discretion to be inappropriate, offensive, in violation of these Terms, or harmful to the Service or its users, at any time and without prior notice.
  • Remove user accounts that repeatedly violate these Terms or engage in other inappropriate conduct, at our sole discretion and without prior notice.
  • Investigate any alleged violation of these Terms and take any action we deem appropriate, including, but not limited to, issuing warnings, suspending access, or terminating accounts.

3.5. Reporting Inappropriate Content: If you encounter any content or behavior you believe violates these Terms, please report it to us immediately at [Your Contact Email Address]. We will review all reports and take appropriate action.

4. Village Membership and Activity

4.1. Village Structure: Villages are small, private groups typically consisting of up to 9 members.

4.2. Participation Expectation: Users are encouraged to actively participate in their chosen Village by consistently posting "Bricks" (goal updates) and providing supportive feedback to other Village members.

4.3. Inactivity and Membership Termination:

  • To ensure active and supportive communities, your membership in a specific Village requires you to have an active goal on your Goalwatch.net account.
  • If you mark an existing goal as "successful" or "failed," you are required to create a new goal within seven (7) calendar days to maintain your active status.
  • Failure to create a new goal within this 7-day period will result in the automatic termination of your membership in your current Village. Your spot in that Village will then become available for other users.

4.4. Rejoining a Village After Termination: If your Village membership is terminated due to inactivity, you may attempt to rejoin your previous Village by creating a new goal immediately. However, rejoining is subject to your previous spot still being available. If your spot has been taken, you will need to search for and join a new Village via the Village Catalogue.

4.5. New Village Creation: If you choose to create a new Village, you acknowledge that attracting new members may require patience, and the growth of your Village will largely depend on your ongoing efforts and the contributions of its members.

5. Subscriptions and Fees

5.1. Freemium Model: Goalwatch.net may offer a freemium version of the Service with limited features and/or Village access.

5.2. Premium Subscriptions: Certain features, services, or unlimited access may require a paid subscription ("Premium Subscription").

5.3. Payment Terms: If you opt for a Premium Subscription, you agree to pay all applicable fees as described on the Service. All payments are processed securely through Mollie. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.

5.4. Billing and Renewal: Premium Subscriptions may be billed on a monthly basis. They may automatically renew at the end of each billing cycle unless you cancel auto-renewal through your account settings or by contacting us.

5.5. No Refunds: All fees are non-refundable, except as expressly provided otherwise in these Terms or as required by applicable law.

6. Intellectual Property

6.1. Our Content: The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Bartosz Dąbrowski and its licensors. The Service is protected by copyright, trademark, and other laws of both Poland and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Bartosz Dąbrowski.

6.2. Your Content: You retain all rights to any User Content you submit, post, or display on or through the Service, and you are responsible for protecting those rights.

7. Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by [Your Business Name/Entity Name].

Goalwatch has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Goalwatch shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

8. Termination

8.1. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. This includes, but is not limited to, violations of our User Conduct and Content policy (Section 3) and inactivity leading to Village membership termination (Section 4).

8.2. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us.

8.3. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Goalwatch, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

10. Limitation of Liability

In no event shall Goalwatch, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

11. Indemnification

You agree to defend, indemnify, and hold harmless Goalwatch and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms; or c) User Content posted on the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

13. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
